The protection of personal information in the private sector is required by the Privacy Act 1988 as amended by the Privacy Amendment (Private Sector) Act 2000 (the "Act"). All employees and officers of HSE Pty Limited ("HSE") are expected to comply with the Act and HSE's policies and procedures concerning the protection of personal information.
This privacy statement applies to any personal information collected online. It explains our practices with regards to collection and processing of any personal information (that is, information from which an individual's identity is apparent or can be reasonably ascertained) that may be collected as a result of your application.
This privacy statement is based on the following principles:
- your personal information will not be shared other than in accordance with this privacy statement, or with your permission and at all times only in accordance with the Act;
- we will use your personal information for the primary purpose for which it was provided, or for secondary purposes otherwise permitted by the Act and for no other purpose, unless you provide permission to do otherwise, subject always to the Act.
If HSE collects any personal information (that is, information from which an individual's identity is apparent or can reasonably be ascertained) such as a person's name or contact details, HSE will comply with the following principles.
Collecting and Using Personal Information
HSE will collect personal information only by lawful, fair and unobtrusive means.
HSE and its related bodies corporate (the "HSE Group") will use personal information only to the extent necessary for the purpose of considering candidates for employment and contract positions within HSE Group or for secondary purposes permitted by the Act and for no other purpose, unless you provide permission to do otherwise, subject always to the Act. Where reasonable and practicable, personal information will be collected directly from the individual.
The Act defines certain types of personal information as "sensitive information", such as health information, genetic information, and other personal information regarding an individual's racial or ethnic origin, membership of a professional or trade association, membership of a trade union, or criminal record.
In general, "sensitive information" is not relevant to employment decisions. For instance, HSE does not collect information about racial or ethnic origin, membership of a trade union or irrelevant personal characteristics.
However, you agree that we may collect certain types of personal information which is considered sensitive information under the Act for employment related purposes. We will seek your express consent before doing so. If you choose to disclose information that is not requested, but is "sensitive", HSE will comply with this policy and the Act in dealing with any such information.
HSE will use personal information collected, including any sensitive information, only for the primary purpose for which it was provided, or for secondary purposes otherwise permitted by the Act, and for no other purpose, unless you provide your permission to do otherwise, subject always to the Act.
Disclosing Personal Information
You agree that we may share personal information on a confidential basis with related bodies corporate and with contractors performing services for HSE Contractors (some of which may be located overseas). Such contractors may include, for example, information technology and telecommunications providers or professional advisers (including accountants, auditors and lawyers), credit reporting and fraud checking agencies, insurers, human resources consultants and credit providers. Otherwise, HSE Contractors' policy is not to disclose any personal information to any unrelated third party, except with consent or where we are permitted by law to do so.
Retention and Disposal of Information
HSE will keep personal information it needs only for purposes permitted under the Act. HSE will de-identify or dispose of such information when it has no further need to use it for permissible purposes or when it is required by law.
You should be aware that the internet is not a secure environment. However, HSE uses all reasonable efforts to ensure that any personal information collected is held securely. In addition, only authorised personnel have access to personal information. Such personnel have agreed to ensure confidentiality of this information and are required to comply with this privacy statement.
Accessing and Upgrading Personal Information
HSE makes every effort to keep any personal information complete, up to date and accurate. Individuals may request access to their personal information and notify us of any change, modification or correction by contacting HSE, our contact details are set out below. Access will ordinarily be granted except in limited circumstances specified under the Act.
